Terms of Service

1. About OziCollect

OziCollect is an online marketplace operated in Australia, connecting buyers and sellers of designer toys and collectibles across Australia and New Zealand. By accessing or using our platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years old to create an account and transact on OziCollect. By using our platform, you confirm that you have the legal capacity to enter into a binding agreement. Accounts found to be operated by minors may be suspended without notice.

3. Marketplace Rules

OziCollect is a peer-to-peer marketplace. We facilitate transactions between buyers and sellers but are not a party to any sale. You agree to:

• Only list items you own and have the right to sell
• Accurately describe items including condition, authenticity, and any defects
• Not list counterfeit, stolen, prohibited, or illegal items
• Not manipulate pricing, reviews, or engage in fraudulent activity
• Communicate respectfully with other users through our messaging system

4. Fees & Payments

Listing on OziCollect is free. A platform fee is deducted from each successful sale: 4.8% (minimum AU$1) for Australian listings, and 6.8% (minimum NZ$1.50) for New Zealand listings. Fees are calculated on the total transaction amount including shipping. Payments are processed securely via Stripe. Sellers must connect a valid bank account via Stripe Connect to receive payouts.

5. Buyer Protection

Buyer funds are held securely until the buyer confirms receipt of the item, or 7 days after the seller marks the order as shipped — whichever comes first. If you receive an item that is significantly not as described, contact us at support@ozicollect.com.au within 48 hours of delivery. We will investigate and may issue a refund at our discretion. This protection is in addition to your rights under the Australian Consumer Law (ACL).

6. Australian Consumer Law

Nothing in these Terms limits or excludes any rights you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable consumer protection legislation. Our goods and services come with guarantees that cannot be excluded under the ACL. For major failures, you are entitled to a replacement or refund. For minor failures, we may choose to repair or replace the item.

7. Prohibited Items

The following items are strictly prohibited on OziCollect:

• Counterfeit or replica items represented as authentic
• Stolen goods
• Items that infringe intellectual property rights
• Illegal items under Australian or New Zealand law
• Hazardous materials

Listings found to be in breach will be removed immediately and the account may be permanently suspended.

8. Intellectual Property

All content on OziCollect — including the logo, design, software, and text — is owned by or licensed to OziCollect and is protected under Australian copyright law. You may not reproduce, distribute, or create derivative works without our written consent. You retain ownership of content you upload (photos, descriptions), but grant OziCollect a non-exclusive licence to display it on our platform.

9. Limitation of Liability

To the maximum extent permitted by law, OziCollect is not liable for any indirect, incidental, or consequential loss arising from your use of the platform, including disputes between buyers and sellers. Our total liability to you for any claim arising from these Terms shall not exceed the platform fee paid in relation to the relevant transaction.

10. Termination

We reserve the right to suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity, or for any other reason at our discretion. You may close your account at any time by contacting support@ozicollect.com.au. Outstanding transactions must be completed before account closure.

11. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes via email or an in-app notice. Continued use of OziCollect after changes constitutes acceptance of the updated Terms.
